Terms & Conditions
OVERVIEW
These Terms & Conditions govern the use of the MM Studios website and the provision of services by MM Studios (“MM Studios”, “we”, “us” or “our”) to clients (“Client”, “you” or “your”).
By accessing our website, requesting a quotation, accepting a quotation, making payment, or engaging MM Studios for any service, you acknowledge that you have read, understood and agreed to these Terms & Conditions, together with any applicable quotation, proposal, project brief or service agreement issued by MM Studios.
Where there is a conflict between these Terms & Conditions and a specific written agreement signed or accepted by both parties, the specific written agreement will take precedence to the extent of the conflict.
Payments
A deposit may be required before work begins. The remaining balance must be paid according to the agreed payment schedule.
MM Studios reserves the right to pause work or withhold final deliverables if payment is overdue.
Additional work outside the agreed project scope may incur additional charges.
Graphic Design
Graphic design projects are completed according to the agreed brief.
The Client must provide accurate information, logos, images, text and other required materials.
The agreed price includes up to 3 revisions. Additional revisions, major changes to the original brief, or any other changes requested after the final project has been approved and completed may result in additional charges.
Web Design
MM Studios will make reasonable efforts to ensure websites, WordPress websites and hosting services operate correctly.
Website and hosting performance may be affected by third-party services, plugins, software, internet outages or other circumstances outside our control.
Hosting and email services may be suspended if payments are overdue.
The agreed price includes up to 3 revisions. Additional revisions, major changes to the original brief, or any other changes requested after the final project has been approved and completed may result in additional charges.
Photography & Videography
MM Studios will make reasonable efforts to capture and deliver the agreed photography, videography and cinematography content.
Specific photographs, videos, cinematic footage or moments cannot always be guaranteed due to circumstances such as weather, venue restrictions, equipment issues, lighting conditions, timing constraints or events outside our control.
RAW files, unedited footage and project/source files are not included unless specifically agreed in writing.
Account & Security
If you create an account with MM Studios, you are responsible for maintaining the security and confidentiality of your account information, including your username and password.
You are responsible for all activities carried out through your account and must notify MM Studios immediately if you suspect unauthorised access or use.
You must not use your account, website, email address, domain name or other MM Studios services in a misleading, unlawful, fraudulent or abusive manner.
MM Studios reserves the right to suspend, restrict or remove accounts or services that it reasonably believes are being used unlawfully, fraudulently, abusively or in a manner that may cause harm to MM Studios or others.
Cancellation & Refunds
If a Client cancels after work has commenced, the Client will remain liable for payment for all work completed and expenses incurred up to the date of cancellation.
Any deposit paid is non-refundable, regardless of whether the Client subsequently cancels the work, unless otherwise agreed in writing or required by applicable South African law.
Refunds, where applicable, will be handled in accordance with the agreed quotation and applicable South African law.
Intellectual Property
Final approved work will be provided to the Client once full payment has been received.
MM Studios retains ownership of working files, concepts, templates and creative processes unless otherwise agreed in writing.
Third-party materials remain subject to their respective licences.
Client Content
The Client confirms that they have permission to use any images, videos, music, text, logos or other materials supplied to MM Studios.
The Client is responsible for copyright or legal claims relating to materials they provide.
Portfolio
Unless otherwise agreed in writing, MM Studios may display completed work on its website, portfolio, social media, and other promotional materials for the purpose of showcasing its services and capabilities.
Privacy
MM Studios may collect and process personal information necessary to provide its services and operate its business in accordance with applicable South African privacy laws, including POPIA.
Liability
MM Studios will take reasonable care when providing its services but cannot be held responsible for indirect losses, third-party failures, downtime or circumstances beyond our reasonable control, to the extent permitted by law.
Nothing in these Terms limits consumer rights that cannot legally be excluded.
Changes
MM Studios may update these Terms from time to time. The latest version will be published on our website.
